Approve the Resolution to amend the Construction Manager At-Risk contract with ECI Site Construction Management, authorize the appropriate Town Officer to execute the agreement, and authorize staff to expend budgeted funds.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
As part of its 2021 work plan, the Board provided direction to accelerate the construction of the Coal Creek Park Redevelopment Project with the goal of having the park open by 2023. The project team worked quickly to update the construction documents to ensure continued compliance with code, standards and specifications, and other external factors. Additionally, the design has been updated to accommodate expanded parking, and a community splash pad for summer use that will transition into an ice rink in the winter.
In October of 2022, the Board of Trustees approved a Construction Manager at-Risk (CMAR) contract with ECI Site Construction Management with a Guaranteed Maximum Price (GMP#1) for initial site work, including fencing, demolition, and clear and grub. This agenda item asks for Board consideration of a resolution amending the current CMAR contract with ECI Site Construction Management for the remainder of the project.
The CMAR method of project implementation allows for early contractor input ensuring efficiencies in design and constructability, real-time costing at various stages of design, and a subsequent GMP which includes competitively bid pricing for all phases/disciplines of the project. The GMP represents the maximum price the Town will pay for the project absent change orders authorized by the Town. The Town has established a reasonable contingency for the project at roughly 5% should necessary change orders occur. The CMAR contract method is currently being used to construct Erie Community Park - Final Phase and has saved the Town over $300,000 in overall project expenses.
Along with appropriations from the Parks Impact Improvement Fund, General Fund, and Tree Impact Fund, the Town has been awarded $555,956 from the Great Outdoors Colorado Community Impact Grant and has a pending award from the Stateside Land Water Conservation Fund (LWCF) administered through Colorado Parks and Wildlife (CPW) in the amount of $449,607. In addition, a portion of the Old Town URA funds will fund the design and construction of the added diagonal parking along Kattell Street north of Wells Street.
The volatile construction market and inflated materials pricing resulting from the pandemic has the potential to cost the Town valuable time and money. It is to the Town’s advantage to amend the CMAR now and lock in pricing for the remainder of the project. Staff is confident the project will be complete in late spring of 2023.
