POLICY ISSUES:

The Town Council is the approval body for the Pre-Development Agreement, Annexation Findings of Fact, Annexation, Initial Zoning, Annexation Agreement and Annexation Plat acceptance; as such the Council must confirm the annexation and agreements comply with all requirements and are in the best interest of the Town.

This annexation includes annexation of half of the roadway for North 111th Street from Boulder County, with the other half remaining within the City of Lafayette. While the Town typically prefers to annex a full roadway, the City of Lafayette prefers to retain ownership and is working with the Town to determine maintenance and permitting for the split roadway. An Intergovernmental Agreement (IGA) between both jurisdictions is underway to define responsibilities for 111th Street into the future. The IGA will need to be in place prior to approving any further land use projects (plats, site plans, etc.) for the property. The Town Council will need to confirm if this approach is acceptable and in the best interest of the Town.

STAFF RECOMMENDATION:

Recommendation

Adopt the resolutions and ordinances for the 111th & Arapahoe Pre-Development Agreement, Annexation Agreement, Annexation Findings, and Initial Zoning.

4.                     Initial Zoning: An Ordinance of the Town Council of The Town of Erie Zoning the Real Property Known as 111th and Arapahoe

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The subject property is comprised of three parcels and a total of 19.33 acres located at the southwest corner of 111th Street and Arapahoe Road. Although the site is within Boulder County, it is surrounded by the Town of Erie to the west and north, and Lafayette to the east and south. The site is located outside of the Town’s Comprehensive Plan Planning Area and as a result does not have a designated future land use. Over the past several years, development interest in the site has included exploration of both townhomes and multifamily residential. This increased interest coincides with recent development of the Nine Mile site at the southeast corner of Hwy 287 and Arapahoe Road.

Development around the Hwy 287 and Arapahoe Road intersection is envisioned to be responsive to its advantageous regional location, high traffic volumes, and existing and future transit access. Both the Town of Erie and the City of Lafayette committed to support regional retail and transit-oriented development on both sides of the intersection. In Erie, the Nine Mile development complements the Safeway-anchored commercial site just to the north with approximately 300,000 square feet of new retail. Nine Mile is anchored by Lowe’s Home Improvement and King Soopers and includes a range of additional retail, and food and beverage uses. Directly east of the Nine Mile development is the 287-unit Savanna Nine Mile multifamily development with buildings that range between two and four stories. Across Hwy 287, the City of Lafayette is planning a mixed-use, walkable, transit-oriented development.

The subject property is consequently located near a key destination in Erie, with access to both shopping amenities and transit. Development of the site poses a significant opportunity to locate residents within walking distance to amenities and transit. Additionally, the project will designate 12% of its units for households with incomes at or below 80% of the Area Median Income. To support the Town’s goals of both affordability and the vision for the Nine Mile area, the site is proposed to be zoned HR, or High Density, with an allowed range of 10 to 25 units to the acre.

Public input received and integrated into the development of the Savanna Nine Mile development just to the west of the property reflected surrounding neighborhoods’ sensitivity to height and traffic impacts. The development review process for the subject property will require at least one public meeting in addition to focused outreach with surrounding neighborhoods. Additionally, the review process will include traffic and utility studies to understand and plan for appropriate infrastructure improvements.

The action items associated with the subject property include adopting two resolutions and two ordinances related to Pre-Development Agreement, Annexation, Initial Zoning, and Annexation Agreement. The staff report outlines the details and information for each.
