SUMMARY AND BACKGROUND OF SUBJECT MATTER: At the July 8, 2014 Board of Trustees meeting, the Town approved an Encroachment License Agreement with Zayo Group, LLC to install Fiber in Erie parkway and 119th Street South of Erie Parkway. Zayo Group, LLC has once again requested using Town right-of-way for the installation of a Fiber Optic line in two locations.  One location is in the intersection of 119th Street and Arapahoe Road and along Arapahoe Road on the west end of the Compass Subdivision.  The second location is along the east end of Ridgeview Road and along Sheridan Blvd between Ridgeview Road and Hwy 7.  (Exhibit A in the attached agreement) This extension of Zayo’s fiber optic service requires a new Encroachment License Agreement. The Encroachment License Agreement will grant Zayo Group, LLC the right to use the Town’s right-of-way for the fiber optic line.  Staff has reviewed the fiber optic plans and do not believe the fiber optic line will conflict with Town facilities.  The agreement also allows the Town to terminate the agreement at any time with a 30 day notice.

The end user of this fiber line is AT&T.  Zayo is adding the fiber for AT&T which will benefit the AT&T users’ in the community.  This fiber line construction will enable AT&T to deploy the latest technology and increase the capacity and bandwidth in the area.  

Staff is recommending approving the resolution and authorizing the Mayor to sign the Encroachment License Agreements.
