Council must approve agreements of more than $100,000. This is to decide whether to expend budgeted funds for a contract amendment to allow the design engineer of record to provide design support services during construction.

• The original Agreement for Professional Services with Consor exceeds $100,000, so amendments to this agreement must also be approved by Council.
• Approving the 2nd amendment allows Consor to receive final payment for finishing the 100% design and provide design support services during the construction phase of the project.
BACKGROUND OF SUBJECT MATTER:
A 2020 study prepared by Fox Tuttle Transportation Group identified traffic operational, safety, and pedestrian accessibility concerns at this intersection. The intersection is located within the boundaries of both the Town of Erie and City of Lafayette (Lafayette).
The Town and Lafayette have an Intergovernmental Agreement to share the cost for the design and construction based on a 25% Lafayette, and 75% Town cost share.
On Oct. 25, 2022, the Board of Trustees approved awarding a professional services agreement to Consor North America to design improvements addressing the current north and south bound vehicle left turn movements from 111th Street to Arapahoe Road, as well as design to improve pedestrian safety and accessibility at the intersection.
On May 5, 2025, staff approved the first amendment for a rate adjustment due to the extension of the project, coordination of additional requirements with Boulder and RTD, and additional work for the final design. This amendment allocated the contingency the Board originally authorized with the original award.
This second amendment includes a split cost of the additional funds for the additional design work that the Town requested following 90% design as well as the addition of construction support services through the construction of the project.
Staff recommend approving the Second Amendment.
