POLICY ISSUES:
Staff’s analysis indicates the proposed DA and proposed dedications are consistent with Town Charter, Municipal Code, and the Council’s priorities. Approving the Resolution will confirm Council’s agreement with staff’s analysis and conclusions. The Lafferty Development Agreement (DA) reflects provisions negotiated by Town staff with the counsel of the Town Attorney, and the property owner, Stratus Canyon Creek, LLC. The DA includes, among other typical Town language, provisions addressing or requiring items to support the Lafferty Canyon Metro District Service Plan approved by Council in March 2023. Those requirements include:
• Plugging and abandoning oil and gas wells and subsequent monitoring (completed in Canyon Creek Filing No. 8)
• Installing solar panels on all homes sufficient to satisfy 50% of energy needs
• Pre-wiring garages for electric vehicle charging,
• Providing water and energy efficient fixtures,
• Monetary contribution towards the Town’s affordable housing program (Completed with the DA for Canyon Creek Filing No. 7 and No. 8) and
• Monetary contribution towards necessary transportation safety improvements within the development (completed with the DA for Canyon Creek Filing No. 7).
The plat was reviewed for all necessary trail, transportation, and pedestrian connections and found to be compliant.
Approving the DA is consistent with the Board’s policy objectives for metro districts and development and will be beneficial to the Town.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Lafferty subdivision property is located at 12166 Jay Road (now Lombardi Street), southwest of the future Lombardi Street right-of-way and the railroad tracks. Below is a map that depicts the site and surrounding area:

Site History and Prior Approvals
1. Annexation
• The Town Council annexed the Lafferty site in July 2020.
2. Zoning
• Concurrently with the annexation, the Town Council initially zoned the Lafferty site Low Density Residential (LR) in July 2020.
3. Plats
• The Town Council approved the Lafferty Preliminary Plat in January 2023.
4. Metropolitan District
• The Town Council approved the Lafferty Canyon Metropolitan District in March 2023.

Development Information:
• Preliminary Plat Size: 39.665 acres

o Single-Family Detached: 132 lots (3.33 du/ac)

The subject property contains two single-family detached structures and various outbuildings. The proposed subdivision plats the existing homes on two separate lots, with the outbuildings anticipated to be demolished. The final plat creates 132 single-family detached lots and ten tracts for landscaping, a pocket park, utilities, trail connections, open area, and drainage. Single-family lot sizes range from approximately 5,200 to approximately 16,600 square feet. Access to all lots is provided through new public streets. One new pocket park and trail connections that tie into the overall development are incorporated into the project.
Development Agreement
Staff negotiated the Development Agreement (DA) in concert with the Final Plat. The agreement includes cost estimates and reimbursement provisions for public infrastructure associated with the development.
