Staff analysis indicates the proposed Development Agreement and proposed plat dedications are consistent with Town Charter, Municipal Code, and the Council’s priorities. Approving the Resolution will confirm Council’s agreement with staff analysis and conclusions.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Erie Four Corners Subdivision Filing No.1 Amendment 1 Minor Plat Amendment and the associated Development Agreement (DA) are part of the project known as the Antelo Apartments. The DA includes standard Town of Erie requirements to develop the site, as well as exhibits outlining phasing and cost estimates for the public improvements the developer will install. These include streets, sidewalks, right-of-way landscaping, irrigation, utility mains, and private improvements with public importance.
The DA reflects provisions negotiated by Town staff with the Town Attorney’s counsel and the property owner, FDG MEQ Erie, LLC. The DA includes, among other typical Town language, provisions addressing fees and public improvements, including:
• Reimbursements to the Town for public improvements
• Fees-in-lieu for park and open space requirements
• Fees-in-lieu for schools
The Antelo Apartments project is located south of Bonnell Avenue and east of County Line Road. This Minor Plat Amendment adds new utility and access agreements, is consistent with the previously approved Final Plat, as well as the Town Center PD zoning for the property.
Site History and Prior Approvals
1. Zoning - This property is within the Town Center PD, approved by the Board of Trustees on March 24, 2020.
2. Plat - The Town of Erie approved a Final Plat for this property on Aug. 23, 2022. Consistent with that Final Plat, this Minor Plat Amendment maintains the two existing lots and existing right of way and will dedicate new utility & access easements.
Erie Four Corners Subdivision Filing No.1 Amendment 1 Minor Plat Amendment

The Antelo Apartments will meet park, open space, and school dedication requirements through fee-in-lieu payments rather than land dedication.
Development Agreement
Staff negotiated a DA in concert with this plat. The agreement includes cost estimates and reimbursement provisions for public infrastructure associated with the development. These provisions address public improvements identified as part of the development review process.
Action Items
The Town Council is the approval body for both the DA and the acceptance of easement dedications as shown on the plat.
Fiscal Impact
The development will pay building permit fees and will generate sales taxes and other taxes to the Town, County, School, and Fire Districts. The resulting revenue will support municipal, school and fire services for the new development.
