SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Nine Mile Corner Amendment No. 2 Subdivision is located south of Arapahoe Road and east of Highway 287. It encompasses 10.24 acres and 3 lots.

The purpose of this minor amendment plat is to dedicate and relocate easements to facilitate the final design of the King Soopers to be constructed on Lot 10A of the Nine Mile Corner Subdivision, and to adjust a lot line between the commercial pad sites on Lot 8A and Lot 9A.

Action Items:

A Development Agreement has been drafted to accompany the Final Plat. It includes cost estimates for public infrastructure associated with the development of King Soopers on Lot 10A. The Board of Trustees is the approval body for both the Development Agreement and the acceptance of dedications as shown on the Final Plat.

Fiscal Impact: The development will pay building permit fees and will generate sales taxes and other taxes to the Town, County, School and Fire Districts, the revenue from which will be used to provide municipal services to support the new development.

History: The property was subdivided in 2020 as the Nine Mile Corner Subdivision to facilitate the development of a retail center (Lots 1-10) and apartment complex (Lot 11). The Board of Trustees approved the subdivision and Development Agreement on March 10, 2020.

The subdivision was amended in 2021 as the Nine Mile Corner Amendment No. 1 Subdivision to adjust a lot line between lots 6 and 7 and amend easements to facilitate the final design of the Lowe’s on Lot 1.

On December 15, 2021, the Site Plan for the King Soopers on Lot 10A was approved by the Planning Commission, with the condition that the Nine Mile Corner, Amendment No. 2 plat is approved and recorded. The plat dedicates easements to facilitate the development of the King Soopers.
