STAFF RECOMMENDATION:

Recommendation

Approve the Resolution with Conditions. Staff finds the Parkdale Masters Property Planned Development (PD) rezoning complies with the Planned Development Approval Criteria and recommends the Planning Commission adopt Resolution P23-04 recommending approval to the Board of Trustees with the following condition of approval:

a.                     Prior to consideration by the Board of Trustees, Applicant shall make all technical corrections to the Application as required by the Town of Erie.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The subject site is generally located north of Baseline Road and west of Coal Creek Boulevard. The property is approximately 17.7 acres in size. The subject site was annexed and zoned in three separate approvals so that the overall subject site currently has three different zone districts that include Low Density Residential, Low Density Residential with PUD-Planned Unit Development Overlay, and PD-Planned Development.

 

Site History and Prior Approvals:

1.                     Annexation

a.                     The Town annexed the subject site in three separate pieces in 2016, 2018, and 2022.

 

2.                     Zoning

a.                     The Town approved zoning associated with each of those annexations - Low Density Residential with PUD Overlay (LR with PUD) (2016), Low Density Residential no PUD Overlay (LR) (2018), and Initial Zoning Planned Development (PD) zoning (2022).

 

Proposed Parkdale Masters Property Planned Development (PD) Rezoning:

This proposed PD seeks to rezone the original Initial Zoning PD area, as well as the two other zoning areas, zoned LR and LR with PUD, to unify all three areas under the new PD with one set of lot and dimensional standards.

 

The applicant is not proposing changes to the allowed land uses within the PD, which will remain primarily single family detached and duplex residential. The applicant does propose a new minimum lot size of 2,800 SF, that would apply.

 

Details on this application and staff’s findings are included in the attached staff report. The next steps for development of the subject site will include a Site Plan application reviewed and approved by the Planning Commission and a Final Plat that will be reviewed by staff with final acceptance by the Board of Trustees.

 

UPDATE FOR May 17, 2023 PLANNING COMMISSION:

This application has been updated to reflect wording, naming, and formatting changes proposed by the Town Attorney’s staff. To more accurately indicate the nature of the application and to improve consistency with UDC language, the name of the project has been updated to the Parkdale Masters Property PD Development Plan (PD-DP). Additional legal language has been added to the PD-DP zoning document itself. Staff continued these changes throughout the packet including the resolution, staff report, and presentations.

 

No substantive changes have occurred in the nature of the zoning proposal itself, as permitted uses, dimensional standards, and architectural standards remain the same as previously proposed.
