Town Council has the authority to review and make a decision on the Preliminary Plat.

 

Recommendation

STAFF RECOMMENDATION:

Staff finds the Spring Hill Preliminary Plat complies with the Approval Criteria and recommends the Town Council approve the Preliminary Plat with the following conditions:

1.                     Applicant must provide the Town with documentation that all oil and gas wells within the boundaries of the Preliminary Plat have achieved plugged and abandoned status with all applicable State and Federal regulatory authorities. If any oil and gas wells within the boundaries of the Preliminary Plat are not currently recognized as plugged and abandoned with applicable State and Federal authorities, Applicant must provide the Town notice within 30 days whenever such wells achieve plugged and abandoned status.

2.                     The Town will not approve a final plat creating residential lots that do not comply with applicable setbacks from Oil & Gas wells whether they be in a Plugged and Abandoned status, Producing status, or otherwise. Applicant must demonstrate that all lots being created satisfy the applicable oil and gas well setback requirements of the UDC, and a No Further Action determination has been granted from the ECMC for all ongoing remediation projects.

SUMMARY/KEY POINTS

                     Consideration of a Preliminary Plat to subdivide 300 acres into 632 residential lots and 49 tracts for future open space, parks, school, and residential development.

                     Proposed single-family detached, duplex, and townhome lots.

                     Plan includes a 10-acre school site and over 36 acres of dedicated parks and open space, with an additional 120+ acres of private open space.

 

BACKGROUND OF SUBJECT MATTER:

The applicant proposes a Preliminary Plat with 632 lots and for future residential development and 49 tracts for future open space, parks, and school land dedication. The applicant anticipates that these lots would develop with single family detached, duplex, and townhome residential units. The proposed tracts will accommodate public open space and parks, site drainage, private open spaces and alleys, utilities, and trails. The preliminary plat proposes access from Highway 52 and Weld County Road 3, as well as a connection with the existing Morgan Hill subdivision to the south.

 

If approved, the next steps for development of the subject site will include a Development Agreement(s), and Final Plat(s) application that will be reviewed by staff with final acceptance by the Town Council. A Site Plan will also be required for the townhome areas.

 

SITE HISTORY:

                     Annexed in 2013; zoned Low Density Residential (LR); Annexation Agreement capped dwelling units at 632.

                     Initial minor subdivision in 2019 to create different development areas.

                     Re-zoned to Spring Hill Planned Development (PD) in 2022 in part to distinguish areas for different residential products (townhome vs. single family detached).

 

 

PLANNING COMMISSION MEETING:

Planning Commission held a hearing on this application on April 1, 2026. The Commission heard comments, asked questions, and deliberated before voting unanimously to recommend approval to the Town Council. Topics discussed were:
