SUMMARY AND BACKGROUND OF SUBJECT MATTER:
In April 2023, in accordance with Resolution 23-052, the Town of Erie executed a Professional Services Agreement with Kennedy Jenks Consultants for Preliminary Design of the Filly Lake Well System Pipeline Improvements.
In April 2024, the Town Manager executed a Professional Services Agreement with Leonard Rice Water Engineers (LRE) to support the Kennedy Jenks preliminary design effort by providing input on the well permitting process, well construction rules, operation and maintenance; and responding to questions on well system design, performance testing, and groundwater hydrogeology.
Kennedy Jenks has submitted recommendations for preliminary pipeline alignments, easement requirements for adequate access for operation and maintenance of the wells and identified three alternative pumping scenarios and associated pumping facility locations to reliably deliver well water to the North Water Treatment Facility. In order to complete the preliminary design additional field pump testing of the groundwater aquifer and well system is needed. This testing would monitor fluctuation in groundwater level; test the groundwater aquifer and well system’s yield capacity to deliver water in a target range of 450 minimum and up to 1000 maximum gallons per minute; and test sustainable pumping flow rates.
This proposed First Amendment is for LRE to provide technical support and manage the overall field testing; with a licensed well subcontractor providing all field management, equipment and labor through the testing period. The testing is proposed to be conducted during the summer, June through July 2024 when historically the groundwater level is at peak. LRE would analyze test data, update the Town’s groundwater model for the area, and recommend the well system estimated yield and sustainable flow rates. Then, Kennedy Jenks would consider LRE’s recommendations to select the appropriate pumping scenario, pump sizes and capacities, pipeline and pumping facility locations to complete the preliminary design.
Staff in coordination with LRE requested proposals from six (6) reputable well subcontractors. Four (4) firms expressed an intent to propose and attended an onsite pre-proposal meeting; however, one firm decided not to propose indicating lack of equipment available, and one firm did not provide a reason for not submitting a proposal.

Staff recommends this sole-source procurement with LRE is appropriate due to the short time frame, LRE’s intimate knowledge of the overall hydrogeology of the area due to their support of the Town’s efforts to develop a wellfield on Boulder Creek, prior completion of aquifer testing for the Filly Lake Well due diligence studies, and their knowledge of the legal aspects of the Town’s efforts in this area.

• September 2020 - Resolution 20-149, approving the Improvements Acquisition, Water System and Operations Agreement by and between the Town and the Shores at Plum Creek Metropolitan District No. 1, 35 Acre, LLC, KOKALOA, LLC and 833, LLC;
• October 2020 - Resolution 20-176, approving the Professional Services Agreement with Leonard Rice Engineers for Assistance with Filly Lake Due Diligence Investigation;
• May 2022 - Resolution 22-60, approving the Agreement to Proceed Pursuant to Resolution 20-149.
Fiscal Impact:
The 2024 Capital Project budget includes $527,963 available to cover this item with 1st Supplemental budget approval.
Staff recommends the Town Council approve the First Amendment to the Professional Services Agreement with Leonard Rice Water Engineers in the amount of $426,073 which includes a base fee of $378,732, and a 12.5 percent contingency of $47,341. Use of the contingency requires an approved agreement amendment.
