SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Baxter Farm subdivision property is located north of Erie Parkway and halfway between 119th Street and Highway 287. Below is a map that depicts the site shaded in gray and the surrounding area:

 

Site History and Prior Approvals

1.                     Annexation

                     The Town Council annexed the overall Baxter Farm area site in 1997 as part of the Isabelle Neighbors Annexation.

2.                     Zoning

                     Concurrently with the annexation in 1997, the Town Council initially zoned the site Suburban Residential (SR).

                     The Town Council rezoned the property to Estate Residential (ER) in 1999.

3.                     Plats

                     The Town Council approved the Baxter Farm Final Plat (concurrently with the rezoning to ER) in 1999. That plat created 13 single-family detached lots and nine (9) tracts.

 

 

Baxter Farm Tract Amendment Subdivision

Development Information:

                     Plat Size:                     5.43 acres

                     for a 3rd existing lot

 

The subject property consists of Tracts D & E and Lot 3 of Baxter Farm Final Plat. Both tracts are vacant, and the existing lot is developed with a single-family home. The original plat states the following note:

 

Tract D, E - Temporary Open Space, to be maintained by the landowner, reserved for future lot development once oil and gas facilities are abandoned and legally removed and capped. Residential lots must be re-platted after wells are capped to designate them residential lots.

 

The oil and gas well that was located on Tract E is now plugged and abandoned, which allows the two tracts to be re-platted as residential lots. All oil and gas abandonment information was reviewed by the Town and found to be in proper order. The plat depicts the required 50’ X 100’ no-build zone per the oil and gas regulations on Lot 15 (former Tract E). Lot 14 will be 2.213 acres and Lot 15 will be 1.938 acres, consistent with the ER zoning. Approximately 12,000 square feet of Lot 15 is platted into existing Lot 3 of Baxter Farms to allow that lot owner a larger lot for additional landscape area. The two new lots would be developed with future custom homes. Baxter Farm Lane, an existing public street, provides access for the development. The developer paid appropriate fees for the Westside Interceptor water line, open space dedication, and neighborhood parks. In addition, no further infrastructure improvements are required. A development agreement was not necessary for this subdivision.
