POLICY ISSUES:

The Erie Junction Development Agreement (DA) reflects provisions negotiated by Town staff with the counsel of the Town Attorney, and the property owner, Erie Junction, LLC. The DA is standard in nature and includes typical provisions such as cost estimates and reimbursement provisions for public infrastructure associated with the development. The main policy issue involves allowing development of an infill project within Old Town Erie. Approving the DA and development will be beneficial to the Town by providing additional housing options within Old Town.

Recommendation

Approve the Development Agreement and accept the dedications shown on the Final Plat for the Erie Junction Subdivision.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Erie Junction subdivision is generally located on the northeast corner of East County Line Road and Balcolm Street in Old Town Erie. Subject site is the former location of a pre-cast concrete manufacturing facility. In 2014 the original building and fencing associated with the concrete business was demolished and the site is now vacant.

Site History and Prior Approvals

1.                     Annexation

                     The property is located within Old Town Erie and has been part of the incorporated Town for decades. The older annexation records are not readily available.

 

2.                     Zoning

                     The property is zoned Old Town Residential (OTR).

 

3.                     Plats

                     The developer provided two Sketch Plans for review. A Sketch Plan is an informal evaluation before detailed planning and engineering work is undertaken and does not result in any approval or denial.

                     The Board reviewed the first Sketch Plan in 2015, which proposed a development consisting of 40 apartment units. The developer did not submit further land use applications for the apartment concept.

                     The developer submitted a second Sketch Plan in 2021, which includes the submittal of the current project under review with this application.

                     The Board approved a Preliminary Plat for Erie Junction on January 25, 2022. That preliminary plat proposed 23 duplex residential lots, three townhome/triplex lots, and four tracts for access, landscaping, utilities, walks, and drainage.

Erie Junction Final Plat

Development Information:

                     Plat Size:                                          2.73 acres

                     Number of Lots:                     23 lots (20 duplex lots & 1 tri-plex lot)

                     Number of Tracts:                     4 tracts

 

Applicant proposes the creation of 23 single-family attached lots, comprising 20 duplex lots and three single-family attached (townhome/triplex) lots. Lot sizes range from 3,043 to 3,617 square feet. Access to all lots is provided through new private streets that connect the overall development to Balcolm Street. Most of the homes will have alley access for garages; six lots on the west side will have front-loaded garages. The development will incorporate sidewalk connections that will tie into existing sidewalk connections. The tracts on the Final Plat contains private streets, landscaped areas, utilities, and detention.

 

Development Agreement

Staff negotiated the Development Agreement (DA) in concert with the Final Plat. The agreement includes cost estimates and reimbursement provision for public infrastructure associated with the development.

Action Items

The Board of Trustees is the approval body for both the DA and the acceptance of dedications as shown on the Final Plat.

 

Fiscal Impact

The development will pay building permit fees and will generate sales taxes and other taxes to the Town, County, School, and Fire Districts. The resulting revenue will be used to provide municipal services to support the new development. Open Space, park, and school fees shall be paid per the DA, which is within seven days of final plat approval.
