POLICY ISSUES:
Staff’s analysis indicates the proposed Maintenance Agreement, Development Agreement (DA), and proposed dedications are consistent with Town Charter, Municipal Code, and the Council’s priorities. Approving the Resolution will confirm Council’s agreement with staff’s analysis and conclusions.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The Erie Four Corners Filing No. 1, Amendment No. 2 site is located on the southwest corner of Erie Parkway and East County Line Road. The subject site was originally platted as Lot 2, Block 6 of Filing No. 1. The property is vacant with surface development but does contain underground detention that was created as part of the first plat. Overall, the site contains 8.0413 acres and is zoned for Erie Town Center Planned Development.
This development is an integral part of the Four Corners project site, envisioned to be a vibrant mixed-use community. The guiding vision document for Four Corners and the Town Center is the Erie Town Center Planned Development (PD) which was approved in 2020. The PD lists both Urban Center and General Urban Zones for the subject property.
This final plat consists of 15 lots and six tracts. The development will provide a wide range of commercial uses, including office space, commercial/ flex space, Incubator/ entrepreneurial space, restaurants, services, and retail (lots 1-10 and lots 14 and 15). Also included are 16 townhome style rental units (lots 11-13). The area will be a highly amenitized, walkable community consistent with the vision for a vibrant Town Center. A central landscaped pedestrian promenade and entertainment plaza is located central to the development, attracting visitors, workers, and residents from Erie and surrounding areas. Should Council approve the final plat, then the site plan for the project can be approved.
The DA for the development includes standard Town of Erie requirements to develop the site, as well as exhibits outlining improvements and cost estimates for the public improvements the developer will install and any reimbursements and fees. These include streets and sidewalks, right-of-way landscaping and irrigation, utility mains, and private improvements with public importance. The Development Agreement reflects provisions negotiated by Town staff with the Town Attorney’s counsel and the property owner. The DA includes, among other typical Town language, provisions addressing fees and public improvements, including reimbursements to the Town for public improvements and fees for parks, schools, etc.
Below is an overall view of the proposed development with proposed building layouts in dark grey. The plat itself can be found with the attachments. Each of the building groups roughly correspond to the proposed lots and are labeled below.

• The property has been annexed within the Town for many decades.
2. Zoning
• Erie Town Cener Planned Development (PD) was approved by the Town Council on 2020. The uses contemplated in this final plat application are consistent with the PD.

• 2022: subject site was platted as Lot 2, Block 6 of The Erie Four Corners Subdivision Filing No. 1.

Maintenance Agreement
Included with this Plat and DA is a maintenance agreement for stormwater facilities related to the previously approved underground detention that was constructed on site. The original DA approved in 2022 indicates the developer is responsible for maintenance of all the improvements on the property. These improvements will be assumed by the Four Corners Business Improvement District (BID). The maintenance agreement holds the BID responsible for the maintenance of the noted facilities.
Development Agreement
Staff negotiated a Development Agreement (DA) in concert with the Final Plat. The agreement includes cost estimates and reimbursement provisions for public infrastructure associated with the development. These provisions address public improvements identified as part of the development review process.
Action Items
The Town Council is the approval body for both the DA and the acceptance of dedications as shown on the Final Plat. In addition, Town Council is the approval body for the acceptance of the sanitary sewer and storm drainage easement.
Fiscal Impact
The development will pay building permit fees and will generate property taxes and other taxes to the Town, County, School, and Fire Districts. The resulting revenue will support municipal, school, and fire services for the new development.
