POLICY ISSUES:

The Town Council is the approval body for the Annexation Findings of Fact, Annexation, Initial Zoning, and Annexation Agreement; as such, if the Council wants to approve the annexation, the Council must confirm the annexation and associated items comply with all requirements and are in the best interest of the Town. There are other factors Council may wish to consider, including the net cost of serving the annexed properties, Town strategic priorities for the future, coordination of services, preserving historic assets, or other policy issues that are not addressed by the annexation criteria.

The proposed annexation includes portions of North 119
th Street and Kenosha Road, which are currently Boulder County roadways.

 

STAFF RECOMMENDATION:

Recommendation

Staff find the annexation eligible and in compliance with Section 7.3, Annexations of Title 10 of the Municipal Code and with C.R.S. 31-12-101 and recommend adopting resolutions for the Erie West Annexation Findings and Lindow Property Annexation Agreement.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Erie West Annexation includes eight parcels and street right-of-way totaling 86.65 acres located near the intersection of North 119th Street and Kenosha Road. These streets and the eight private properties are in unincorporated Boulder County. The area is located within the Town’s Comprehensive Plan Planning Area Boundary. The Future Land Use Map designates this area as Agriculture land use, which is consistent with the current use of the properties. The property owners desire to retain their current rural and agricultural character and have no intention of redeveloping now or in the near future.

 

Boulder County has purchased many properties in this area for open space, and the property owners desire annexation into the Town to achieve a greater degree of certainty around future land use decisions that impact them. From the Town’s perspective, these properties offer the Town an opportunity to extend jurisdiction northwestward and extend the Town’s land use policies to these properties.

 

Under the proposed Agricultural Holding (AGH) zoning, the property owners may continue to use their properties as they currently do - as rural/agricultural properties with single-family dwellings and accessory buildings.

 

Left Hand Water District currently serves the properties with water infrastructure. Each property possesses a septic system to handle sanitary sewer needs. In accordance with the UDC, this utility infrastructure may remain in existence until the point in time when redevelopment necessitates extension of utility lines, which will be the responsibility of the property owner(s).

 

The action items associated with this annexation case include adopting two resolutions as well as an Annexation Agreement for the Lindow Property. If Council approves the annexation, it will also be necessary to adopt an ordinance related to Annexation and Zoning during a subsequent public hearing at a later date. The staff report outlines the details and information for these actions.
