SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Final Plat and Development Agreement for Rex Ranch Filing No. 3 were approved by the Board of Trustees on July 27, 2021. The current owner of the property (HT Flatiron - Hines) wishes to convey the land associated with Filing No. 3 to Taylor Morrison of Colorado, Inc.  The attached Resolution, provided for consideration by the Board of Trustees, will assign all rights, improvement obligations, covenants, promises, and requirements under and pursuant to the Development Agreement for Rex Ranch Filing No. 3 Subdivision to Taylor Morrison of Colorado, Inc.

 

The address of the site is 2839 North 119th Street which is located west of 119th Street.  Rex Ranch Filing No. 1 surrounds the Filing No. 3 property to the north, south, and west.  The final plat consists of ten single-family lots and one tract.  Lot sizes range from 9,000 to 13,000 square feet.  Access is provided to the lots through Rex Ranch Filing No. 1, by means of an extension of Red Iron Court to the south.  No direct access is provided onto 119th Street to the east.  The development incorporates trails that would tie into the overall Rex Ranch development and a sidewalk to be installed along 119th Street.  This is the final filing within the Rex Ranch Subdivision.

History:

The properties for Rex Ranch Filing No. 1 and Filing No. 2 were annexed by the Town in November 2006, and the area for Filing No. 3 was annexed in January 2018. The final plat for Rex Ranch Filing No. 1 was approved by the Town in November 2017, and the final plat for Rex Ranch Filing No. 2 was approved in November, 2019.  The Preliminary Plat for Rex Ranch Filing No. 3 was approved by the Board of Trustees in August, 2020.  The maximum gross density limits for all of Rex Ranch set forth in the Annexation Agreement is 133 total units on 98.28 acres, or 1.35 units per acre.  Filing No. 1 consists of 60 units, Filing No. 2 consists of 63 units, and Filing No. 3 consists of 10 units.  This meets the maximum gross density allowed.

 

Action Items:

A Consent to Assignment has been drafted for the BOT to authorize the reassignment of the Rex Ranch Filing No. 3 Final Plat DA.
