SUMMARY/KEY POINTS

                     A lease agreement requires Council approval.

                     The City of Lafayette is planning improvements to the floodplain near the Lafayette Water Reclamation Facility, which is adjacent to the Coal Creek Regional Trail and the work will require closure.

                     To keep the trail accessible, the City proposed a detour on Town-owned property.

 

BACKGROUND OF SUBJECT MATTER:

The City of Lafayette will complete floodplain improvements along Coal Creek near its Water Reclamation Facility, which requires a temporary closure of a segment of the Coal Creek Regional Trail. To maintain continuous public access, Lafayette requested use of Town-owned property for a temporary trail detour. The detour follows an existing access route adjacent to the work area and keeps the regional trail system functional during construction.

 

The License Agreement grants Lafayette a temporary, revocable right to use the property for non-vehicular trail purposes through Dec. 31, 2026. Work is expected to begin in late May or early June and should be completed within 120 days. Lafayette will maintain the detour at its sole expense, including vegetation management, signage, and general upkeep. The agreement requires Lafayette to carry insurance, assume responsibility for any damage, and restore the property to its current condition once construction concludes.

 

Staff and the Town Attorney reviewed the agreement and find the terms acceptable. After Town Council approves the resolution tonight, Lafayette Town Council will review it at their May 5 meeting and fully execute the agreement.
