POLICY ISSUES:

Staff’s analysis indicates the proposed Development Agreement (DA), proposed dedications, and partial easement assignment are consistent with Town Charter, Municipal Code, and the Council’s priorities. Approving the Resolution and Ordinance will confirm Council’s agreement with staff’s analysis and conclusions.

Recommendation

Approve the DA and accept the dedications shown on the Colliers Hill Filing No. 6 Final Plat subdivision. In addition, accept the ordinance approving the partial assignment of a Sanitary Sewer and Storm Drainage Easement Agreement

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Colliers Hill Filing No. 6 Final Plat site is located within and platted as part of the larger Colliers Hill subdivision. This will be the final large plat of the development and will conclude years of development within the Colliers Hill Subdivision. The property is located on the northwest corner of WCR 5 and WCR 10 and is vacant. Overall, the site contains 151.72 acres and is zoned LR - Low Density Residential with the Colliers Hill Planned Unit Development (PUD) Overlay which allows single-family and duplex housing types.

The final plat consists of 480 residential lots consisting of 338 single-family detached lots, 142 paired (duplex) lots, and 28 tracts, one of which will be a neighborhood park (Tract Q). Single-family detached lot sizes range from 5,743 to 18,029 square feet, and the paired lots range from 2,250 to 5,852 square feet. Access to the single-family lots is provided through new public streets that connect to the overall Colliers Hill development. Duplex lots front onto public streets or garden courts and have access to garages via private alleys. The development incorporates private open areas and trail connections that tie into the overall area.

The Colliers Hill Filing No. 6 DA includes standard Town of Erie requirements to develop the site, as well as exhibits outlining phasing and cost estimates for the public improvements the developer will install. These include streets and sidewalks, right-of-way landscaping and irrigation, utility mains, and private improvements with public importance. The Development Agreement reflects provisions negotiated by Town staff with the Town Attorney’s counsel and the property owner. The DA includes, among other typical Town language, provisions addressing fees and public improvements, including reimbursements to the Town for public improvements and fees for parks, schools, etc.

 

The proposed drainage improvements impact the property directly to the west. While this drainage area is to be maintained by the applicant, the Town needs the right to enter the pond area at any time for inspections or maintenance if necessary. The easement grants this right to the Town and has provisions to recoup costs from the developer if necessary.

Colliers Hill was zoned concurrently with Annexation with the following districts and overlays:

                     LR - Low Density Residential

                     SR - Suburban Residential

                     ER - Estate Residential

                     AG/OS - Agriculture/Open Space

                     Colliers Hill Planned Unit Development (PUD) Overlay District

 

3.                     Plat and Amendments

                     2011: The area for Filing No. 6 was platted in November 2011 as Tract 18 of the Bridgewater Master Subdivision Final Plat. Tract 18 has been designated for future development since the original platting.

                     2021: Town Council approved a Rezoning request on Sept. 14, 2021.  The rezoning changed most of the Filing 6 site from Estate Residential (ER) zoning to Low Density Residential (LR) zoning.

                     2021: Town Council approved Colliers Hill PUD Amendment No. 6 on Sept. 14, 2021. Among amendments for other areas in the development, PUD Amendment No. 6 created Village 1A allowing up to 350 single family detached dwelling units, and Village 1B allowing up to 150 Alley-loaded duplexes, both of which are within the Final Plat No. 6 area.

                     2023: Town Council approved the Colliers Hill Filing No. 6 Preliminary Plat on Jan. 24, 2023. The proposed Final Plat is consistent with the approved Preliminary Plat.

Development Agreement

Staff negotiated a Development Agreement (DA) in concert with the Final Plat. The agreement includes cost estimates and reimbursement provisions for public infrastructure associated with the development. These provisions address public improvements identified as part of the development review process.

Action Items

The Town Council is the approval body for both the DA and the acceptance of dedications as shown on the Final Plat. In addition, Town Council is the approval body for the acceptance of the sanitary sewer and storm drainage easement.

 

Fiscal Impact

The development will pay building permit fees and will generate property taxes and other taxes to the Town, County, School, and Fire Districts. The resulting revenue will support municipal, school, and fire services for the new development.
