SUMMARY AND BACKGROUND OF SUBJECT MATTER:

Staff and legal counsel have been working on updating Chapter 12 of the Unified Development Code (UDC) 2019. There have been many opportunities for input from residents, industry experts and the Board of Trustees.

 

On October 21, 2020 counsel and staff presented a draft version of proposed updates to the Planning Commission. The Planning Commission voted on a resolution to approve Chapter 12 as presented, the resolution failed with a vote of 3 yeas and 3 nays. The minutes from the Planning Commission are attached. 

 

At the October 27, 2020 Board of Trustee meeting counsel and staff presented for discussion a draft of the proposed amendments to Chapter 12 of the Unified Development Code (UDC) were presented. Additional comments and input provided at that meeting have now been incorporated as redlines in this final draft being presented for the Board’s consideration. The attached redline document uses as the base document, a “clean” version of what was presented at the October 27th meeting.

 

Tonight the Board may take action on the proposed amendments to the UDC Chapter 12 - Oil & Gas Regulations in one of the following ways:

                     Vote yes to approve as presented

                     Vote yes to approve with conditions

                     Vote no
