The policy implications of this item include whether to expend funds on the expansion of the Erie Police Department facility for long lead time items and to secure subcontractor agreements. The approval of this item will be a step toward the eventual execution of Certificates of Participation.

SUMMARY/KEY POINTS
• This resolution ensures the Police Department Expansion and Remodel project stays on schedule and current budget projections are maintained.
• Acquiring long lead time items now will minimize the risk for cost escalation and/or tariff impacts.
• Council approval is needed to secure the most competitive and predictable pricing available on long lead procurement items and ensure items are received when needed for the project.
• Council approval is needed to execute subcontractor agreements including delegated design contracts for foundational systems and other critical infrastructure items.
BACKGROUND OF SUBJECT MATTER:
On Sept. 10, 2024, the Town Council Approved the Award of a Consultant Contract to D2C Architects for the Police Department Expansion and Remodel Project Design. On Aug. 26, 2025, the Town approved the award of a Construction Manager at Risk (CMaR) agreement to Fransen Pittman Construction for Pre-Construction Phase services.
The current resolution before the Town Council includes the First Amendment to the CMaR Contract to facilitate the execution of subcontractor and vendor contracts, and the early procurement of mechanical and electrical equipment, elevator equipment, structural steel materials for the Construction Phase of this Contract. The cost as recommended is $10,364,616.
FUTURE AMENDMENTS:
Staff anticipates bringing to Town Council for approval two additional amendments to this CMaR Agreement. The Second Amendment will be for the Cost as Recommended amount to facilitate the execution of subcontractor and vendor contracts, and the early procurement of foundation and site utility materials to ensure project mobilization remains on schedule. The final amendment will be for the balance of the work for the Final Guaranteed Maximum Price (GMP) for the expansion. The Final GMP will not exceed the agreed amount of $41,194,462 Fixed Limit of Construction Cost (FLCC).
