Title
A Resolution of the Town Council of the Town of Erie Approving the First Amendment to the Development Agreement for Summerfield Filing No. 1
Body

DEPARTMENT: Planning and Development
PRESENTER: Christopher C. LaRue, Principal Planner

POLICY ISSUES:
Staff's analysis indicates the proposed Development Agreement (DA) Amendment is consistent with Town Charter, Municipal Code, and the Council's priorities. The amendment supports the overall health and safety of the community by ensuring re-plugging of an abandoned well on-site. Additionally, the amendment makes provision for the upsizing of sewer lines to efficiently accommodate future growth beyond the project area.

STAFF RECOMMENDATION:
Recommendation
Approve the First Amendment to Development Agreement for Summerfield Filing 1.
End
SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Town Council approved the original Summerfield Filing 1 Final Plat and Development Agreement in July 2023. In order to accommodate future development in the vicinity of the property, the Town has requested the Developer upsize certain portions of the sewer line that serves the project. This DA amendment will amend the terms related to the sewer line upsizing and revise Exhibit B of the DA to adjust the costs. In addition, it allows the Town to reimburse the developer for the upsizing.
The Summerfield Filing No.1 subdivision is generally located south of Highway 52, between Weld County Roads 5 and 7. The plat encompasses 615.6 acres and is included within the larger 976.9-acre Summerfield area. The site has been identified for residential and mixed-use development as part of the Summerfield Planned Development - Development Plan.
