POLICY ISSUES:

Adopting the proposed Ordinance will repeal the section of the municipal code requiring that annual appropriation bill be passed by ordinance to avoid inconsistency with the Home Rule Charter which prescribes the budget be adopted by resolution.

STAFF RECOMMENDATION:

Recommendation

Approve Ordinance 023-2024 to amend the Erie Municipal Code to repeal section 2-1-1 as it is superseded by the Home Rule Charter

End

SUMMARY AND BACKGROUND OF SUBJECT MATTER:

The Town Council must approve many actions to fully implement the Erie Home Rule Charter (Charter). Among the provisions requiring Council action is Article 13.05(1) which specifies the Town Council shall adopt a resolution adopting the budget and a resolution adopting annual appropriations. With adoption of this ordinance the inconsistency of the municipal code with the Charter will be removed.
