SUMMARY AND BACKGROUND OF SUBJECT MATTER:

Many Homeowners Associations (HOAs) in Erie manage land owned by the Town of Erie. The Town currently owns the property containing the Erie Commons neighborhood pool, yet it is not responsible for operations or maintenance. Although a replat of Erie Commons Filing No. 1 Final Plat (Replat D) was recorded in 2006, correcting the tract (Tract H) ownership back to the HOA/Metro District, a quitclaim deed was never executed. Following staff coordination with the HOA and approval from the Metropolitan District, the attached ordinance will appropriately designate ownership of Tract H back to Erie Commons Metropolitan District No. 1. The Erie Commons HOA and Erie Commons Metropolitan District No. 1 have an existing maintenance agreement for the pool.

The attached ordinance represents a crucial step in rectifying the ownership status of Tract H back to Erie Commons Metropolitan District No. 1. By formalizing this transfer, the Town ensures clarity and accountability in the ownership, management, and maintenance of the Erie Commons neighborhood pool.
