SUMMARY AND BACKGROUND OF SUBJECT MATTER:

At the Dec. 12, 2023, Regular Meeting, the Town Council approved the Ranchwood Development Agreement and accepted dedications as shown on the final plat for Ranchwood Filing No. 1. The Town owns a segment of the Leyner-Cottonwood Ditch (the “Ditch Segment”) that traverses through the Ranchwood project site. The site is intended be developed primarily as residential with future commercial development, in accordance with the Erie Town Center Planned Development Guide. To facilitate the project, the Developer wants to place a portion of the Ditch Segment on the property in an underground pipeline along with associated structures at the Developer’s sole cost and expense within the area described and depicted on Exhibit B.

The license agreement is required by the Town to allow modification to the Ditch Segment. This license agreement requires the Developer to bear all costs associated with the piping and sets forth construction conditions, permitting, acceptance, and financial security.

Approving this ditch license agreement with the Town ensures the timely and efficient construction of the Ranchwood development within Erie Town Center.

FISCAL IMPACT:

Approving this ditch license agreement has no fiscal impact.
