Zoning decisions are key to implementing the Town's Comprehensive Plan and vision. The intent of this discussion is to provide an overview of the zoning process and make sure the presentations and information staff presents regarding zoning decisions enable Council to make informed decisions reflecting the development context and required criteria for approval.

SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The intent of this memo and planned Study Session discussion is to outline the Development Review process for initial zonings and rezonings within the Town. This process comprises two phases: the first, an evaluation of the appropriateness of the proposed uses in relation to surrounding development and applicable plans; and second, detailed development review to ensure implementing the zoning integrates the Town's environmental, infrastructure, and design standards.

Since zoning decisions are quasi-judicial, they are brought before both the Planning Commission and Town Council in Public Hearings. The information and criteria evaluated as part of the public hearing is dictated by the Town's Municipal Code. While a concept plan illustrating the proposed zoning use may be available and presented by the applicant, it is not required as part of the criteria for the zoning decision. More detailed planning is typically initiated after the zoning decision, when an applicant applies for development review of subsequent land use applications, such as plats or site plans.
