SUMMARY AND BACKGROUND OF SUBJECT MATTER:
The New Consolidated Lower Boulder Reservoir and Ditch Company and Northern Colorado Water Conservancy District own a 72-inch concrete pipe used for overflow from their ditch prior to the ditch crossing Briggs Street.

As part of the Coal Creek Improvements north of Cheesman Street that are currently under construction, the Town has relocated a waterline that crosses under the 72-inch overflow pipe and will be constructing a new wingwall for the Briggs Street/WCR 1.5 bridge that the existing 72-inch pipe will be protruding through.

Town staff worked with the New Consolidated Lower Boulder Reservoir and Ditch Company and Northern Colorado Water Conservancy District during the design of the Coal Creek Improvements. A portion of the creek crosses property owned by the ditch companies where they have a ditch syphon that goes under the creek. The construction plans include improvements to protect the syphon as it crosses Coal Creek. The Town entered into a license agreement for that work. The work on the overflow pipe was missed in the first agreement and we now need to enter into an agreement for the work impacting the overflow pipe.
