SUMMARY AND BACKGROUND OF SUBJECT MATTER:
Senate Bill 2022-99 created the requirement for Municipal Courts to automatically seal criminal justice records where the case against the defendant has been completely dismissed, or the defendant has been acquitted of all counts.
Senate Bill 2022-99 also updated the procedures for non-automatic sealing of criminal justice records. These changes include the requirement for Municipal Courts to serve all custodians of the criminal justice record with a copy of the sealing order.
Repealing and reenacting section 1-4-14 will align the Erie Municipal Code with the requirements of Senate Bill 2022-99.
